‘Does the builder have a right?’ - Your reaction over controversial land grab on six back gardens in Preston

Homeowners on a new development in Cottam, Preston, revealed how their housing developer was claiming back part of their gardens.

Residents at six houses in Harvester Drive received letters from Wainhomes, stating the rear fence line to the properties had been ‘erected in the incorrect position’ and that the builder was sending workmen round to move the fence.

Resident Carley Crook told the Post on Monday: “To be honest we wouldn’t have bought the house if we’d known it would end up having a smaller garden.”

Surely if you bought the house with those visual boundaries and the land registry confirmed there is no actual measurement on the deeds then the builder has no legal right to do this.’

The deeds to a house will show the boundary of a garden and property and after its signed it’s like a contract agreeing. If it was that easy to over turn no doubt other developers would be doing it to try and grab a bit of land. I’d go to solicitors, citizens advice and everyone I can do to find out.’
