A man accused of attacking his cousin’s boyfriend at a family party has been cleared.

Kerry Peacock was accused of attacking Paul Eastham after being found in his younger cousin’s bedroom with a girl he brought to a gathering.

Peacock, 21, of Whernside Crescent, Ribbleton, Preston, denied a charge of grievous bodily harm and a jury at Preston Crown Court found him not guilty of the allegation following a trial.

Prosecuting, Jane Dagnall told the jury of seven men and four women Mr Eastham suffered a fractured cheekbone at a 40th birthday party for Mr Eastham’s girlfriend’s mum in Ambleside, Brookfield, Preston, on October 28, 2012.

Defending, Jon Close, told the court Peacock, who suffers from Asperger’s syndrome, had hit him in “self defence” because he believed Mr Eastham was going to hit him.
