Parking fine mum saved by wedding photos

Mum-of-three Sue Ustian was saved from a parking fine - by wedding photos.
Sue, 58, was furious to find an attendant slapping a ticket on her Vauxhall Astra in the car park at Netto in Towngate, Leyland, when she went shopping shortly after the wedding.

Sue pointed out she had only been in the supermarket for about 20 minutes – but the warden claimed she had parked there twice in two hours, breaking the rules.

Quick-thinking Sue whipped out her digital camera to show the attendant photos she took at the wedding, complete with date and time, to prove she was half-a-mile away on Bow Lane an hour earlier, when she was alleged to have first been at Netto.

Now, after weeks of wrangling with Netto and enforcement firm Excel Parking, Sue has had her £40 fine dropped.

Sue, of Cuerden Avenue, Leyland, said: "I could have been bullied into paying as a lot of other people could be."

A spokesman for Sheffield-based Excel Parking said: "The lady appealed the notice and everything was taken into consideration."

A Netto spokesman added: "We are pleased to hear that Sue's case has been resolved and we hope that she will continue to shop with Netto in the future."

You got to wonder about some of these supermarkets. Talk about shooting yourself in the foot. What happens if you do your own shopping and then take your Mum shopping? or even forgot something. As long the person is in the supermarket why does it matter if they been once or 3 times in 2 hours. Just another way of a cheap store getting money. But im sure Tesco's wont mind if u want to hit your customer with silly fines for shopping with you.

It like these shopping centre's that only give 2 hours to shop in 60 shops.

Stop shopping at Supermarkets that use such underhand bully boy thugs to "enforce" parking. Customers should vote with feet or wheels and take custom somewhere more friendly and accommodating. It seems no one is safe in rip off Britain!!!

I was under the impression that these parking fines from private companies were legally unenforceable.She should have just ignored the ticket.

How does that prove she wasnt there ealier, anyone can set the date/time on a digital camera to anytime they want.

Even if the date/time was accuate she could have still been parked there while someone else gave her a lift to the the wedding half mile away. Dosent exactly take long to travel half a mile in a car.

Was the car the best man at the wedding because all it proves is that she was at the wedding and not with the car.
If she is the registered owner she is still responsible for where its parked.

Many people use supermarkets as 'park & ride' venues for themselves and car-sharing friends to avoid City Centre parking fees. Not saying this lady is one of them - being in Leyland - but can't blame supermarkets for clamping (lol) down on regular offenders. Sainsbury's in Deepdale is a notorious venue when PNE are at home.

Come on, LEP!!!!! Do some research. This woman was NOT fined. What she received was an entirely unenforceable invoice from Excel.

Mrs Ustian really didn't have to go to all the bother of proving she was elsewhere. She was not liable to pay any "fine" in any event.

Simply put, the invoice is a penalty based on a purported contract. Penalties are not allowed under contract law.
