A man caught with cannabis has avoided prison despite breaching a conditional discharge for possession of the Class B drug and battery.
Paul Whiteside, 23, of The Close, Kirkham, near Preston, admitted having a quantity of cannabis in his possession when stopped by police in Cabus, near Garstang, on September 12 last year.
Lancaster Magistrates’ Court heard he had committed a further offence while subject to a conditional discharge imposed by Fylde Coast Magistrates’ Court on November 11, 2012 for possession of the drug and battery on October 22 that year.
Magistrates fined Whiteside £35, told him to pay a £20 victim surcharge and ordered that the cannabis be forfeited and destroyed.
However, they decided not to take any action on the breach.
