Smoking pub in 'last chance saloon'

A club manager has been told she is in the last chance saloon after becoming one of the first in Preston to be caught flouting anti-smoking laws.
Donna Stevens has been threatened with prosecution if members at Fishwick Ramblers Working Men's Club light up again.

She has been hit with a final warning letter amid threats by council bosses that it is the "final stage before prosecution".

ut Ms Stevens, boss of the Mornington Road club, has hit back, saying pubs and members clubs are being crippled by the ban which came into force in July last year.

She said a few members "taking the Mick" in February was to blame for her being hauled before council officials.

The manager said: "A council official came in just as we were sorting the situation out with the members who had been smoking but he was not interested in any explanations and called me for an interview.

"I know the law is the law but my view is that we are a members only club and if people do not like people smoking, they do not have to become a member.

"We are suffering the effects of the ban like everyone else, no-one likes standing outside in the cold during the winter but hopefully that will improve in the summer when the weather gets better."

Preston Council said two people were issued with £50 fixed penalties since the ban – which prohibits smoking in public places – came into force.

A council spokesman said: "On the whole Preston has responded very well to the smoke free legislation with most premises now operating as smoke free. This is reflected in the low level of enforcement notices and fixed penalties which we have had to issue."

A spokesman for South Ribble Council said the authority had issued two fixed penalties and "several warning letters".

She said: "Our emphasis in the first few months has been in contacting and educating employers. Now that's been in position for a few months, we are turning towards enforcement.

"I would expect the number to rise in the next few months unless everybody is being good."

Fylde Council said the authority had "only issued several warnings" while Chorley Council is taking legal action against a non-payment of a fine.

Elspeth Lee, Cancer Research UK's head of tobacco control, said: "The legislation was introduced to protect workers and the public from secondhand smoke. Research shows the health of bar workers has improved dramatically."

Blackpool landlord Hamish Howitt was the first publican in England to be convicted for breaching smoking ban legislation last November.

The Happy Scots Bar owner recently failed to overturn the ruling using human rights law.

Elspeth Lee says the health of bar workers has improved dramatically? Where does she get these figures from? I thought Cancer Research was a 'charity' to help combat cancer but they seem to be paying people like Elspeth tons of dosh to come up with these unsubstantiated figures. People raise money for this so called charity who are a major contributor to the anti-smoking band wagon. Did anyone notice the other headlines from this paper about shootings and stabbings? and all the council are worried about is a landlady from a working mens club allowing someone to have a cigarette! It's time to put things in perspective as there is no proof at all that second hand smoke killed anyone. How on earth do we have a growing population of elderly people who lived through times when most of the adult population smoked any we all had coal fires. Why as well has the occurence of asthma gone up when the smoking population is decreasing year by year? It's time people stopped believing all the crap that cancer research and co spout. They cannot come up with reliable figures and spend alot of money that should be spent on cancer research instead of propaganda. Donna Stevens should be congratulated for standing up to these bullies.

Why are they never this tough on 'real' criminals?

Personally I have never smoked, but the way they treat people who have not enforced this new civil law goes well beyond the call of duty.

It strikes me that those who smoke could send the government a very clear message if they stopped buying tobacco with the UK duty paid. Then see how strong a resolve the politicians have.

If it is a workingmens club,then it is a private club,it is not open to the general public,it is only open to private members,so as mentioned in the Labour manifesto before the last election,exempt,this smoking ban is killing our Hospitality Industry and putting thousands out of work and in a lot of cases,out of home,the Clubs and Pubs are the ones to decide,smoking or non smoking,it is not up to a Government that LIES to the people before an election,enough is enough,Tug.

As a lifetime non smoker, I'm with the smokers on this one. I'm a grandfather so I lived through the smoking age and never have had a problem with second hand smoke. The British government are a bunch of crack pots. Rebel as suggested by Martin Luther King.

I dont like being told what to do with my life,im an adult,not a kid,i choose to smoke,lets have smoking pubs and clubs...none smokers can go to non smoking establishments,is that ok?Where are all these non smokers now?Not in our pubs....middle class Chardonnay drinkers that stay at home!

Far too many pubs, clubs, cafes and bingo halls have closed due to the smoking ban.
How about CRUK using our donations to investigate the effects of isolation and the loss of social contact on those whose recreation has been taken from them or even the beneficial effects of wonderful clean air that the newly unemployed and bankrupt are enjoying. There is plenty of evidence to show that Social health is a far more influential factor in longevity than any single activity.
Had any political party announced their intention to damage businesses, close pubs/clubs etc and destroy communities and remove pleasure from the 'under-classes' they would never have been elected but this so-called Labour government has successfully hurt the very people that support(ed) them.
