Gang youth's city ban is relaxed

A gang member who terrorised parts of Preston has had an order banning him from the entire city relaxed.
Andrew Walch, 18, was given a five year anti-social behaviour order in February 2007 prohibiting him from Fishwick, St Matthew's and Farringdon Park until 2012.

In January this year, the ASBO was altered by Preston Magistrates to ban him from all parts of Preston, but this has been overturned by the appeal at Preston Crown Court.

Timothy Hodgson, representing Lancashire Constabulary, requested a full ban on three key areas and Walch is not allowed access to Church Avenue and Bidston Street – where his mother lives.

He is banned from using public buses to travel through New Hall Lane and the boundary of the exclusion zone has been extended to include both sides of Blackpool Road.

Walch will be released from Hindley Prison on Monday after serving a four month sentence for handling stolen goods and racially aggravated assault.

Judge Dodds said that Walch should consider himself lucky that he is allowed to come back into Preston at all and that he had "done well enough".

PC Dave Johnson, Fishwick community beat manager, said: "The amendments made to the order should provide the community with respite and thanks goes to all those members who have assisted the police in compiling its application."

After the hearing, defence solicitor Greg Earnshaw said: "On behalf of my client, I have always argued that the application by the police to exclude him from the whole of Preston and the surrounding districts was certainly unreasonable and possibly unlawful."

Walch had previously been charged with breaching his ASBO on three occasions by entering an exclusion zone.

He continues to be banned from wearing anything that restricts view of his face, being in a public place with named individuals, using racial or verbal abuse, threats of violence and using a car in a way that causes alarm to people.
